THE LEGAL FRAMEWORK


Local policies in support of the solid waste management program of the City have been developed over a number of years. As early as 1992 the LGU passed “Ordinansiya Municipal No. 4, s-1992”, an ordinance providing for the maintenance of cleanliness and sanitation in the City. In 2001, Executive Order No. 09 Series of 2001 was signed creating the City Solid Waste Management Board(SWMB) and in 2002 the Passi City Environment Code has been enacted. In 2002, The City Mayor approved the creation of the Operation Linis Program allocating a budget of P1.4 M for its operations. Since then the Operation Linis Program under the Office of the City Mayor is responsible for the collection and transfer of solid wastes in 5 barangays in the City and for the maintenance of cleanliness in public places including the public market, city hall, and the city’s plazas and recreation centers. Later, other local laws have been passed such as Ordinance 2004-012 enacting the Passi City Ecological Solid Waste Management Act. E. O. No. 27, s 2004 reorganized the Passi City Solid Waste Management Board, and a follow-up order created the Technical Working Group (TWG) for Solid Waste Management which is specifically aimed to provide technical support and assistance to the SWMB and to work directly on the City´s solid waste management activities with the DENR-EMB 6 and GTZ-AHT Solid Waste Management for LGUs. When the LGU initiated plans and programs for the establishment of the City´s sanitary landfill, the City Mayor approved E.O. No. 24, s-2006 creating the Special Project Implementing Unit (SPIU) tasked to facilitate the compliance of all documentary requirements needed for the construction of the sanitary landfill in Passi City . In January 2007, E.O: 01, s-2007 has been signed creating a special pre-qualification, bidding, and awards committee for the proposed construction of the sanitary landfill in barangay Aglalana, Passi City.
